About CPSNB

The College of Physicians and Surgeons of New Brunswick has responsibility within the province of New Brunswick, Canada for:

  • the licensing of physicians
  • monitoring standards of medical practice
  • investigating complaints against physicians

In addition to these three primary areas of responsibility, the College is often approached for advice in ethical, medical-legal, and general quality of care matters. The College operates under the authority of the Medical Act and applicable regulations.

  1. For the purpose of subsection 60(1) of the Act, the "costs of the Council" shall include all of the expenses of, costs of, fees and disbursements incurred and related to the investigation or hearing or both of a complaint against a member or associate member including but not limited to the following:  

    (a)  All costs and expenses incurred by the College, the Council, the Review Committee, the Complaints and Registration Committee and a Board of Inquiry including legal costs on a solicitor and client basis;

    (b) Honoraria paid to members of the Council, the Review Committee, the Complaints and Registration Committee and a Board of Inquiry;

    (c) The travel, accommodation and meal expenses of the members of the Review Committee, the Complaints and Registration Committee and a Board of Inquiry;

    (d) The fees and expenses, including travel, accommodation and meal expenses of any investigator retained by the College in connection with the complaint;

    (e) The cost of reporting services including transcripts and other expenses for the Court Reporter;

    (f) Expert fees both for the preparation of written opinions and attending to give evidence at any hearing including travel, accommodation and meal expenses incurred by such expert witness;

    (g)  Witness fees;

    (h)  Expenses of witnesses incurred for the purpose of attending any hearing;

    (i) Costs of service of documents, long distance and telephone and facsimile charges, courier, delivery charges, postage, photocopies, binding of documents and similar miscellaneous expenses;

    (j) Any other expenses of the College directly attributable to the investigation or hearing of the complaint against the member or associate member.

  2. The cost of the Council shall include all applicable taxes including HST.

  3. Tariff D under Rule 59 of the Rules of Court shall not apply for the purposes of the Council's assessment of the costs of the Council under subsection 60(1) of the Act.
